The ongoing court case involving the Lawrence-Scioto County Solid Waste Management District and Lawrence County Community Action Organization is set for trial in November.


It has been over a year since LSSWMD cut ties with the CAO. Caught in the middle of what appears to be a messy divorce between the two organizations is the question of who owns vehicles that the staff of the LSSWMD were driving at the time of separation. The vehicles include a 2008 GMC Savana Pass Van 3500, a 2006 GMC Envoy, a Leonard open-utility trailer, a 2008 Pontiac G6, and a 2012 Chevrolet Equinox.


A pretrial was held on the case in January, and Danielle Parker, assistant Scioto County prosecutor, said a trial will be set for later in the year. Parker recently said the case is set for trial in November unless the two organizations can come to a settlement ahead of time.


Since the dispute began, information and documents have been gathered from both sides trying to seek a resolution to the issue. Unable to come to a resolution, in March of 2013, Parker filed a complaint for declaratory judgment on behalf of the LSSWMD.


“Danielle (Parker) went ahead and got a trial date set for November. By that time those cars will have sat for two years and it’s worrying me to death,” said Dan Palmer, Lawrence-Scioto County Solid Waste Management District coordinator.


Palmer has report issues that are starting to appear with the vehicles, as a result of non-use. Issues include, dead batteries.


“I talked to a mechanic and he said the longer you let this thing (car) sit, the worse this vehicle is going to be,” Palmer said. “We can use one of our trailers that we typically use for cleanups. That’s going to hurt is this spring when we got all of these programs scheduled.”
